Scope of Coinsurf Services & Member Interactions

Coinsurf operates an online marketplace that enables registered users (“Members”) and certain third parties (“Hosts”) to publish listings for short‑term or mid‑term stays, experiences, or related services (“Listings”), and enables other Members (“Guests”) to discover, request, and communicate about such Host services (“Host Services”). Coinsurf does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Listings or Host Services, and Coinsurf is not a party to contracts between Members. Any contract is solely between Host and Guest.

Coinsurf is not a real‑estate broker, insurer, or payment intermediary for Member‑to‑Member arrangements unless specifically stated for a particular region or feature.

Members are solely responsible for their interactions with other Members. Coinsurf may, but is not obligated to, monitor interactions or assist with dispute resolution.

To promote Listings, public pages or widgets may appear on third‑party sites, in apps, emails, or ads. Translations (including those powered by third parties) may be provided for convenience; accuracy is not guaranteed.

Due to the nature of the internet and maintenance, Coinsurf does not guarantee continuous or uninterrupted availability of the Platform and may modify or suspend features to protect security or improve functionality.

Eligibility, Compliance & Member Verification

You must be 18+ (or the age of majority where you live) and able to enter binding contracts to use the Platform.

You must comply with applicable export control and sanctions laws and represent that you are not located in, or a resident of, a jurisdiction subject to comprehensive sanctions and are not a prohibited party.

Access to certain features may require verification steps, quality or eligibility criteria, ratings thresholds, or history checks. Coinsurf may request government ID, selfies, or run checks against databases, where lawful and with consent where required. Verification indicates only that a check was completed; it is not an endorsement or guarantee.

If you download the app from an app store, you agree to that store’s license terms. Mapping features may use Google Maps/Earth and are subject to Google’s terms.

Changes to These Terms

Coinsurf may update these Terms. We will post the updated Terms with a revised “Last updated” date and, for material changes, provide additional notice (e.g., email or in‑app) at least 30 days before they take effect.

If you disagree, you may terminate under Section 16 before the effective date. Continued use after the effective date constitutes acceptance.

Accounts

You must register an account to use certain features (e.g., publish or request a Listing). If registering on behalf of an entity, you represent that you have authority to bind that entity.

Provide accurate, current, and complete information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for activities under your account. Notify support@coinsurf.com of suspected unauthorized use.

Unless permitted in writing, you may maintain only one personal account. Coinsurf may enable features to add co‑hosts or team members without sharing credentials.

Content & IP

“Member Content” means content Members provide (text, photos, video, reviews, messages). “Coinsurf Content” means content the Platform makes available (including without limitation UI, copy, images, and code), excluding Member Content. “Collective Content” means both.

Coinsurf and its licensors own the Platform and Coinsurf Content. Except for the limited license below, no rights are granted.

Subject to these Terms, Coinsurf grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to access and use the Platform for your personal, non‑commercial use.

By making Member Content available, you grant Coinsurf a non‑exclusive, worldwide, royalty‑free, transferable, sublicensable license to host, store, reproduce, adapt, translate, publish, and display such content to operate, promote, and improve the Platform. You represent that you own or have rights to grant this license and that your content does not infringe others’ rights or violate law.

You will not post content that is unlawful, harmful, deceptive, defamatory, obscene, discriminatory, or otherwise violates our policies. Coinsurf may remove or disable content that violates these Terms or is harmful.

Coinsurf respects IP rights. If you believe content infringes yours, see our Copyright Policy for instructions (e.g., DMCA notice details where applicable).

Fees, Payments & Platform Role

Coinsurf is not a party to Host‑Guest contracts and does not collect or process payments between Members unless explicitly stated for a specific product or region. All Listing fees, deposits, and other charges are set by Hosts and handled directly between Members.

Coinsurf may charge optional or future fees (e.g., identity/review verification), which do not change Coinsurf’s non‑party status. If introduced, fees and terms will be disclosed at purchase.

Terms for Hosts

Provide complete and accurate Listing information, including description, location, availability, house rules, restrictions, and any requirements. Keep calendars up‑to‑date.

You are solely responsible for setting Listing prices (including applicable taxes) and any security deposits. Coinsurf does not administer security deposits between Members.

You are responsible for compliance with laws, permits, registrations, HOA/lease rules, zoning, safety requirements, and insurance appropriate for your Host Services.

Accepting a booking request creates an agreement between you and the Guest only.

Terms for Guests

You may request a Listing subject to any Host requirements and verification steps. All amounts shown during a request flow (e.g., Listing price, deposits, taxes) are set by the Host and are indicative only until confirmed by the Host. Any binding agreement, including payment obligations, is outside the Platform unless Coinsurf explicitly provides a payments feature in your region.

A confirmed stay typically grants you a limited license from the Host to enter and use the Accommodation for the booked period. Overstays may incur additional charges as set by the Host and allowed by law. Coinsurf does not administer or enforce such charges.

You are responsible for ensuring additional guests meet Host requirements and for supervising minors.

Modifications, Cancellations & Resolution

Hosts and Guests are responsible for any booking modifications they agree to (on‑platform or off‑platform). Coinsurf is not a party and does not adjudicate contractual outcomes between Members.

Cancellations are governed by the Host’s policy and applicable law. Since Coinsurf does not process Member‑to‑Member payments (unless explicitly stated), refunds (if any) are handled directly between Members.

Coinsurf may publish automated notices (e.g., indicating a Host cancelled) or block dates to reflect platform activity.

Ratings & Reviews

Reviews and star ratings reflect Member opinions, not Coinsurf’s. They must be fair, truthful, and factual; manipulation is prohibited.

Where available, Coinsurf may surface “Verified” badges for reviews imported from other platforms, which may be inaccurate or incomplete; Coinsurf does not guarantee their accuracy.

Damage; Member Disputes

To the fullest extent permitted by law, you release Coinsurf (and its officers, directors, employees, and agents) from claims, demands, and damages arising from disputes with other Members. If you are a California resident, you waive California Civil Code §1542 as described here.

Taxes

Hosts are solely responsible for understanding and meeting tax obligations (e.g., VAT, income, occupancy/tourist taxes) and including such amounts in pricing where applicable.

Laws may require collection/remittance of occupancy or similar taxes. Unless Coinsurf explicitly offers a tax feature in your region, Coinsurf does not administer such taxes between Members.

Prohibited Activities

You will not, and will not assist others to: violate laws or third‑party rights; misuse personal data; spam; list properties you lack rights to offer; misrepresent affiliations; harass or discriminate; scrape, crawl, or harvest; circumvent security measures; reverse engineer; damage or impair the Platform; export or re‑export contrary to law; or otherwise engage in harmful conduct. Coinsurf may investigate misuse and request information to support such investigations.

Term; Suspension & Other Measures

These Terms begin when you accept them and renew on a rolling 30‑day basis until terminated.

You may terminate at any time by closing your account (Email: support@coinsurf.com). You remain responsible for any separate agreements with other Members.

To protect Members, comply with law, or address violations, Coinsurf may remove content, limit or suspend access, block dates, revoke status, or terminate accounts—with notice where appropriate for non‑material issues.

Upon termination, your license ends and certain sections survive (see Section 21). You may not register a new account if your prior account was suspended or terminated.

Disclaimers

If you choose to use the Platform, you do so at your sole risk. The Platform and Collective Content are provided “as is” and “as available” without warranty of any kind, express or implied (including merchantability, fitness for a particular purpose, non‑infringement, or availability). Coinsurf does not control or guarantee Listings, Host Services, Member conduct, or translations. Some Host Services may involve inherent risks which you assume.

Limitation of Liability

To the maximum extent permitted by law, Coinsurf will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, service interruption, computer damage, or the cost of substitute services, arising from or related to your use of the Platform or interactions with Members, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility.

In no event will Coinsurf’s aggregate liability exceed the greater of USD $100 or the amounts (if any) you paid to Coinsurf for chargeable Platform features in the twelve (12) months preceding the event.

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.

Indemnification

You agree to defend, indemnify, and hold harmless Coinsurf and its affiliates, and their officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or policies, your misuse of the Platform, your Listings or Host Services, your interactions with Members, or your violation of law or third‑party rights.

Dispute Resolution & Arbitration

Before filing a claim, you and Coinsurf agree to attempt to resolve the dispute informally by emailing legal@coinsurf.com with a brief description and your contact details. If unresolved after 30 days, either party may proceed.

United States: Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules, as modified by this Section. The Federal Arbitration Act governs. The arbitrator may award any relief a court could on an individual basis. No class actions or representative proceedings. Jury trial is waived.

Hearings may occur in your county of residence, San Francisco County (CA), another agreed location, by phone/video, or for claims under $25,000, on written submissions only.

Filing fees follow AAA rules. Prevailing‑party attorneys’ fees may be awarded as allowed by law and AAA rules; Coinsurf will not seek fees unless the claim is frivolous.

If the class‑action waiver is held unenforceable as to a claim, this arbitration agreement is void as to that claim.

Feedback

By submitting feedback, you grant Coinsurf a worldwide, perpetual, irrevocable, royalty‑free license to use it for any purpose without compensation and without any obligation of confidentiality.

Governing Law & Jurisdiction

United States residents: California law (without regard to conflicts rules) governs. Courts in San Francisco, California (for small‑claims or matters not subject to arbitration) have exclusive jurisdiction.

EU/UK and elsewhere (outside the U.S. and China): Irish law governs, without prejudice to mandatory consumer protections in your country of residence. Consumers may bring proceedings in Ireland or in their country of residence. Businesses submit to the exclusive jurisdiction of Irish courts. The CISG does not apply.

Residents of China: Chinese law governs. Disputes will be submitted to CIETAC in Beijing under CIETAC rules (English language). Either party may seek provisional relief in competent courts.

General Provisions

These Terms, and any policies referenced, constitute the entire agreement between you and Coinsurf regarding the Platform.

No joint venture, partnership, employment, or agency relationship exists between you and Coinsurf.

No third‑party beneficiaries unless expressly stated.

If a provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver.

You may not assign these Terms without Coinsurf’s consent. Coinsurf may assign to an affiliate or in connection with a merger, acquisition, or sale of assets with 30 days’ notice.

Coinsurf may provide notices by email, in‑app, or posting on the Platform. EU consumers may access the EU ODR platform at http://ec.europa.eu/consumers/odr (Coinsurf is not obliged to use ADR entities).
